House Speaker Nancy Pelosi (D-CA) and openly gay Rep. Barney Frank (D-MA) have declared transgender people a drag on the Employment Non-Discrimination Act (ENDA). To ensure its passage, they have introduced a non-inclusive bill that would offer job protection only on the basis of sexual orientation - not gender identity. There is a separate employment bill for transgender people, but it has about as much chance of passing as Sen. Larry Craig becoming the ad pitchman for Charmin.

If we could ensure that transgender Americans would be included in a couple of years, the "pragmatic" approach would make sense. However, let's drop all pretenses and admit that when we talk of an "incremental" approach it is code for at least a fifteen-year increment of time. Furthermore, with campaign seasons getting excruciatingly long, it is always an Election Year - thus a permanent excuse to perpetually exclude transgender people.

It is also clear that a minority as small as the trans community will never have the political clout to go at it alone, nor will they have the funds to wage a credible fight in Congress unless Bill Gates wakes up tomorrow and decides to have a sex change. To put it bluntly, their only chance at legal protection is under the gay and lesbian banner. So, dropping an inclusive bill means under no uncertain terms that we have abandoned transgender people and told them to fend for themselves.

The real question the larger gay and lesbian population must answer is whether it is worth it to sacrifice our rights in the immediate future to support transgender equality? This is not an easy call to make, as some purists would suggest. By opposing ENDA in its current incarnation, we will leave thousands of families vulnerable, particularly in "red states."

To me, this is a deeply personal issue because I was fired from a television news-reporting job in Bangor, Maine in 1994. There is nothing more I would like to see than the passage of ENDA, to help people who are now in the situation I once faced. I understand better than most the social and economic consequences of having a career short-circuited because of sexual orientation, with no legal recourse.

But, I also have the memory of working at the Human Rights Campaign's Pride booths each summer at a time when transgender people were excluded from ENDA. Inevitably they would confront us and I would dutifully defend our policy. The more I thought about it, however, the less I could justify my words and I could barely look them in the eyes. We were essentially saying, "stop piggybacking" on the gay rights movement. That is the same self-centered argument that right wing African Americans use today to justify exclusion of gay people from civil rights protections.

The HRC staff and leadership came to the identical conclusion and thus supported a new trans-inclusive version of ENDA. How bittersweet it must be for HRC to finally get an opportunity to pass its signature piece of legislation, yet have the occasion marred. Contrary to what critics are now saying, HRC cares deeply about transgender people and does want them included.

Personally, I would not support the current ENDA bill because we simply owe too much to the trans community. Unable to hide, they have been in the forefront of the movement, often at great personal risk. They have sacrificed much for those of us who could "pass," so now it is time to return the favor, even if it means biting the bullet on ENDA.

Some people think transgender people are a hindrance to greater acceptance. My years in the movement have taught me that thugs believe we are all "faggots" and religious fanatics think we are all "sinners," regardless of whether we wear suits or skirts.

Furthermore, the right will portray any bill - gender inclusive or not - as allowing men with beards in dresses to demand jobs as elementary school teachers. Remember, lying is what the far right does best and any member of Congress who votes for equality in any form will be smeared. So, why not do what is right and defend transgender inclusion?

What our community must do is tell Congress that it is morally unacceptable to dole out rights to only groups that poll well. Either a legislator believes in the principle of equal justice for all or they don't. As painful as it might be, we must reject a compromise that compromises our core values. The next time I come face-to-face with a transgender person, I want to be able to look them in the eyes and know I did the right thing.

I agree with you Wayne and it's also been my experience that most heterosexuals, especially men, wouldnt recognize a pre-op transgendered woman unless she whipped her penis out and wagged it in their face.
Back in the 80s, when The Crying Game came out, I went to see it with a hetero. female friend, who had lots of gay male friends. We didnt know what the 'big secret' was, but as soon as the 'girl' in the beauty salon opened 'her' mouth; we just looked at each other and whispered, 'that's a guy in drag'. I assumed that most of the audience had gotten it until the part when 'her' penis was revealed and the entire theater started gasping and OMGing. We wanted to say hellloooo, you mean you didnt know? Once again, as with gay marriage, they're making a big tadoo out of something that is really no big deal. Of course transgendered people should be included in ENDA.

Passing a federal non-discrimination bill for gay people would be a thunderous achievement and would be a MAJOR milestone. Unfortunately, they simply don't have the votes for the inclusive version. They aren't there. We should not lose this rare opportunity to pass ENDA and to continue, afterwards, to fight for our brothers and sisters who are transgender to receive the same protections.

Thank you Wayne! I have never understood my gay brothers and sisters who are willing to throw trans people under the bus for a "seat at the table". I personally have no desire to sit at a table that excludes trannies and genderqueer folks. That would be a boring table indeed.

Whether the assimilationist cowards in the gay and lesbian community like it or not, the fact is that we are all trans people in the eyes of the religious right. I don't care if you are a white, card-carrying Log Cabin Republican gay male with an MBA who is also on the baseball team at the local Southern Baptist Church. You are still a queer and your life is considered to be just as cheap as that of a black tranny-boy by Focus on the Family and their minions.

Principles are wonderful, but every improvement, even if incremental, lays groundwork for further improvement. If after a few years of ENDA as is, and there are no examples of big-fag-teacher-in-a-beard-and-dress showing his partially removed genitalia, i think they will have a harder time excluding it later.

This is similar to the North American Episcopal bishops who just stabbed GLBT people in the back again by genuflecting to the biggots in order to prevent a schism. They voted not to ordain any more openly gay, non-celibate bishops, nor to do any same-gendered blessings. For the sack of 'unity' and typically UNchristian of them, they've kicked the marginalized away from Christ's Table. No wonder the pews are empty, they should all go to fucking hell!

Chris L... That's really quite optimistic of you. This bill, in *any* incarnation, won't survive the certain Bush veto.

What this boils down to... is what's more important to Barney Frank et al: the queer community's solidarity, or getting a last-minute political notch in his bedpost to flaunt at the HRC National Dinner?

It isn't about civil rights for either LGBT *or* LGB. Not so long as congress can't overcome a veto.

Chris L. - that's not what has happened in the past.

17 years ago, Mass. passed a GLB-only bill. The T wasn't included. It still isn't, but worse, there is no sign that it ever will be.

5 years ago in NY, a GLBT bill was rendered GLB-only so it would pass that session, not the next. Again, the T's are still waiting, and again, no-one can predict when a bill for T people will get into committee, let alone out and on to the floor for a vote. Not this decade, certainly.

There has never been a case where a GLB bill has been followed by a more comprehensive one. Not once.

Now there's arguments for a GLB only bill to be passed. But please, no self-deluding statements about "and we'll come back for T later", because the historical record shows that "later"=="never". If T people are to be stabbed in the back, sacrificed for the greater good, let there be no self-deception about it.

I am tired of the fringe elements of our community hijacking the movement and forcing us to accept their perversion and wigs and leather. Sick!! Sick!! Sick!!

It is time that all moral, good homosexuals stand up and say NO to the transvestites that bring us down. You people are a detriment and are damaging normal gays like me and my lover. We don't wear leather - we wear Polo shirts. We are the MAJORITY.

Finally, stop using the word queer. It means freak. Speak for yourselves. We only hang out with straights and they all think we are acceptable and normal people.

Thank God HRC is keeping the fat drag queens off ENDA. I am sending them a check.

OK folks... a little crash course on Washington lobbying 101 here..

I think people need to stop and think how legislation is passed in Washington.

Bottom line: if you absolutely do not have the votes to include gender identity at this time, but do have the votes for sexual orientation, then you pass it with sexual orientation. Period.

I'm active in workplace ERGs and understand gender identity issues. And I fully support including gender identity in ENDA, but if no amount of backroom deals and arm-twisting can get those additional votes for it to pass in both houses Congress, then it gets removed. Sorry, that's how it works in Washington and state houses across the country, like it or not. Politics means compromise.

People need to remember one thing: ENDA itself is a "far weaker" bill (to use Lambda's hysterical action alert terminology today) than the comprehensive federal gay and lesbian civil rights bill introduced decades ago.

What's that? Never heard of that bill, you say? That's because it never went anywhere, so they ditched it.

So yes, ENDA is a watered-down version (employment only) of the comprehensive bill, just as a sexual oriention-only ENDA is a watered-down version of the one that includes gender identity.

An incremental approach is not settling for half a loaf, it's not self-loathing, and it's not anti-trans. It's reality.

Ignore the we're-not-free-until-we're-all-free crowd and think for yourself. That joined-at-the-hip thinking is dangerous. It's exactly how our enemies like Focus on the Family and the Family Research Council operate.

The bottom line is this: those that demand all or nothing are grossly uninformed about how Washington operates or they're selfish.

If we have the votes for a smaller scale ENDA, there's only one reason to make that gay man in Arkansas or that lesbian in Mississippi wait for protection: Selfishness. (Remember what happened at Cracker Barrel.)

Don't let the not-for-profits tell you how to think. They'll gladly take your money and give you a T-shirt in return. But when it comes time to pass real legislation, they blink. Remember, the not-for-profits are based in places like Washington, New York or San Francisco. They have their protection. They'd sing a different tune if they were in Tyler, Texas or Huntsville, Alabama.

The truth is, a gender identity-inclusive bill will come with education and patience. The scare tactics about being forgotten or left behind are tired, old talking points. Won't happen, trust me. Here's why: Evidently people have forgotten the strong-arm tactics used by the trans community on HRC when ENDA originally did not include gender identity.

Anyone who tries to hold hostage a scaled-down version of ENDA that can be passed in both chambers, needs to be publicly called out as the selfish hypocrite that they are.

And any legislator that attempts to withdraw ENDA from a vote because it is scaled down, should be removed from office in the next election.

JJ, you are on the right track. "All or nothing" is exactly how the fundies act and we can't afford to do that. Trannies aren't being "dropped" or "dragged" - resources that were once used to protect GLB's from discrimination can now be funneled to protection T's, because official government protection will be the law for the GLB's.

Try to keep in mind it isn't just the trannies you'd be jettisoning. As self-loathing Walt points out, drag queens and gender queers would also be out in the cold. Ok, maybe that's not you, but butch lesbians and effeminate gay guys are SOL too. Strip the gender protections and you're left with femme lesbians, straight-acting gay guys, and bisexuals, who are already the least likely members of the community to be discriminated against. Just how many of us are you willing to throw under the bus to get yours? Maybe even yourself?

We all have to keep in mind who we're dealing with: Republicans! Those types hear the term "gender identity" and imagine a man parading down the street in red spike heels followed by a pink poodle on a sequined dog collar. The G.O.P. has repeatedly and consistently shown ignorant hostility toward the civil rights of all groups.

To this very DAY, they deny the humanity of many Americans, even going so far as to promise to limit the ability of courts to address the various inequalities that people who are different must endure in a country that claims that "liberty and justice for all" is its motto.

They haven't the FAINTEST appreciation or understanding of people's differences. They TOTALLY miss the beauty of it all, and they have no realization of the poignant struggle of the transgendered amongst us. Sadly, to pass ENDA, we must wheel and deal. Such is Washington D.C.

People who say things like that are the people who bring us down!

The part of GLBT, the people you talk about, Sir or Madmam, are the fun/colorful part of GAY. The people you talk about aren't Transexual people trapped in a body that doesn't belong to them, but fun loving
transvestites.
The gay folks who like dressing in "drag" and having fun.
You hang around stra8 folks who accept you because you try to emulate them, they sure as hell don't try to emulate you.

So you see, the "T" in GLBT is for Transexual not transvestites they already belong in the "G" part and possibly the "B" part of those initials as well.
My point is ENDA is for all GLBT & Q AND A, not to exclude anyone whose different!

Obviously there are some misinformed people here. If we EVER expect the straight community to respect transgender people, we should start by educating our fellow gay people first:

TRANSGENDER: an umbrella term for anyone who does not conform to "traditional" gender roles.

And yes, as someone pointed out, this can include effeminate men (whether they are gay or straight) and masculine women (whether they are gay or straight).

TRANSSEXUAL: Someone who feels as though their physical sex does not match up with the gender they feel they are on the inside. Some, but not all, seek out hormone therapy and surgery (i.e. physical sex change).

TRANSVESTITE: Someone who enjoys dressing in the clothes of the opposite sex, usually in private. Most often heterosexual men.

DRAG QUEEN/KING: An actor who temporarily dresses up like the opposite sex, almost always in a flamboyant and comical way, and performs musical numbers or skits in front of audiences.

Oh, and the stripped version also allows employers to refuse to extend health benefits to LGB's partners. So the bill may not actually do anything, but at least we can put it on Bush's desk for a veto anyway! That'll show em!

I've not been able to find this information. Who are the legislators on the fence? It would appear the sexual orientation-only version is being done to give political cover for those in more conservative districts.

Do we even have a simple majority for the sexual orientation-only version?

Sorry, but I have to say this:

Like clockwork, the hit job has begun. The SF Chronicle reports that 100 GLBT groups (whatever "group" means) would pull their support for ENDA without the trans protection. And Pelosi's office in SF is the target of protests too. I can just picture them stamping their feet and holding their breath until their faces turns blue.

Can you say special interests? HRC, NGLTF, O&E, Lambda, and the rest of the alphabet soup crowd have come out of the woodwork and decided that they know what's best for us. How quaint.

As I say to evangelical Christians: Put the Bible down and learn to think for yourself. The same applies here for us: toss the action alert emails aside and formulate your own opinion on this issue.

Assuming the votes are there for a sexual orientation-only version of this bill, if that Washington-based cabal is successful at scuttling ENDA, any gay man or lesbian who contributes even a dime to these organizations needs their head examined.

At their next national dinner-- a black-tie event which costs an arm and a leg to attend-- I want Matt Foreman, Joe Solmonese and the rest of the gang to stand before the podium and tell that gay man or lesbian in Mississippi why no protection is better than some protection. I, for one, would love to see their math on that one. And then, after they've done that, they can tell us all why we should continue to give them money. What's the bang for the buck, the return on the investment?

As someone who has a voice in how my company's employee resource group spends its money, I will do everything I can to redirect funding to the local level. They don't deserve a penny.

... That is, if they torpedo ENDA. Let's all hope that doesn't happen. Nobody wins then....

These people are us! They didn't Just come out of the wood work and they have been working for all of us as well as you. How insulting that remark was to those who work Hard fighiting for us! How much have you paid to one of those attorneys from Lamda Legal or any other Gay attorney organization that has been working for us? Why don't you stop thinking about yourself for a change. No wonder we can't get anything done, we don't have the brains to stick together. Well that was ment for the few on this comment list. My thanks to Wayne and all the other folks who are willing to stick it out and wait for ALL of us to be included in ENDA.

Sorry, but every indication is that the community as a whole is strongly against stripping the gender provisions out. You can call it special interests if you want, but that seems kind of, you know, quaint.

I do not accept the exclusion of transgendered people from this bill. I don't accept crumbs, we've waited far too long and we've been far too patient and too politically correct. If Bush uses his veto, what will the democrats do then? Without a mandate in November 2008, assuming the win, they're not going to be able to do anything without a majority in both houses.

To be good AND moral would be to stand up with those Transvestites who are different from you.

I don't think Waynes article is about Transvestites at all though, it's about leaving Transexuals, Gender Identity, out of the ENDA bill.

Lambda Legal, a special interest gorup??? NOT, just sent out a post. Here's a portion of it I'd like you to read, if you don't receive their mail:

Earlier today we also released a joint statement with four other LGBT legal organizations (the ACLU, the National Center for Lesbian Rights, Gay & Lesbian Advocates and Defenders, and the Transgender Law Center) to further explain our concerns about the new version of ENDA to our communities.

As our letter to Congressman Frank states, the new bill is "...far weaker by denying the protection that would have been provided by the earlier version to those who may not identify as transgender but who are discriminated against because they are perceived as gender nonconforming. Lesbians, gay men and bisexuals frequently are perceived that way."

As legal organizations, we have together been responsible for most of the public interest litigation involving LGBT rights in this country. We all hear from people every day who have suffered discrimination based on sexual orientation and gender identity. Our combined experience shows that we need the strongest laws possible to protect all members of our community from discrimination.

Passing a weakened bill now will make it harder for LGBT employees to fight discrimination for years to come. We need a bill that covers all of us, and we pledge to continue to offer our legal expertise as we work to achieve that goal

Please read Barney Frank's initial response-- the one that generated Lambda's letter you posted. He explained point by point what was problematic to some in Congress. At the end of the day, the votes are not there for wording on gender non-conformance and wording about benefits. That's what Barney stated. Lambda conveniently ducked that part. Moreover, Lambda seems to suggest that without gender conformance, ENDA would be rendered toothless. While this wording is important to have, that is hardly the case-- and there's data to show that. Not all discrimination based on sexual orientation is due to gender non-conformance.

If no bill passes (and word gets out that a scaled-down version could have), then it gets real ugly. Then we really will see the gay community throw the trans community under the bus. The all-or-nothing activists and protesters are not the majority of gay community, even though some would like to think so.

HRC knows this. This is why they have done the right thing by staking out a middle position and saying they want the trans-inclusion but won't actively oppose the non-trans version. They appear to know that the votes are there for the scaled down version.

So ENDA passes; HRC is on record supporting the trans-inclusive version, but yet we still have a federal gay workplace bill- something unprecedented.

Most important, HRC doesn't abandon the gay and lesbian community by actively opposing a version of ENDA that can pass and protect gays/lesbians. By doing that, they will keep their corporate donors and others who contribute to them.

As of the other day, HRC was being attacked by the all-or-nothing wingnuts who think of it as a sell-out. Why am I not surprised?

Cool heads must prevail. Wayne raises several good points about sacrifice and not leaving the trans community behind on this. He's right. However, I'm concerned about the backlash that will result if a trans-inclusive ENDA is voted on and fails, when it becomes known that a sexual orientation-only version would have passed.

I have contacted my congressman and told him to support a trans-inclusive ENDA, but if the version sent up for a vote is sexual orientation-only, to then support that one. He's a straight ally, so I'm confident he'll vote for either version.

In the end, it appears there is no outcome which will please everyone. But something is better than nothing (in my opinion).

JJ in Chicago, first of all I wonder why you would think Lambda would neglect or omit something or try to screw us over, they have as much to loose as any of us, they're the ones working on it and if you're going by what I posted there's a link, that I didn't post to check out Barney's statement, so they didn't leave anything out.

And although there were different views on which road to take, I personally received strength in knowing that our goal-enacting one bill that protects the entire GLBT community-would be the ultimate destination.

Three rock-solid principles have guided my decision-making throughout this ordeal: a) In the context of decisions that lawmakers had made, HRC must craft a strategy that would achieve an inclusive ENDA most expeditiously; b) an "incremental" strategy that said we'd "come back and pick up gender identity in a few years" was not acceptable; and c) we couldn't affect change if we weren't part of the legislative process. Those principles have dictated all of my actions and will continue to do so.

That final principle-staying in the game in order to influence the outcome-has, thus far, been almost unique to HRC, and the actions we've taken based upon it have come under intense scrutiny by others. No matter how difficult it is to come under fire, however, we know that turning our backs on our relationships with Congress is not an acceptable strategy for HRC. It would completely incapacitate us in the fight for a complete bill. Everything that has transpired in the past week, and everything that we will do going forward, reflects this basic understanding: if we remain outside of the legislative process, we have no hope of influencing it.

And as we remain engaged in the legislative process we continue to unequivocally state that (a) we only support a complete employment bill-meaning one that provides the most robust protections for everyone in our community, whether gay, lesbian, bisexual, or transgender; and (b) we do not support the removal of gender identity from ENDA. I won't leave anyone wondering about where HRC stands: we do not support the incomplete bill recently introduced in Congress, and we only support a complete ENDA. Period.

In service of our mission and our principles, at this very moment the Human Rights Campaign is engaged in a full-scale lobbying effort focused on targeted members, both on the Hill and with in-district grassroots work, to support a complete bill. We are facing an uphill battle but we refuse to give up-to quote Bill Clinton-"until the last dog dies."

Our community can work with the people who want to help us, or we can walk out on them. We can fight to move the ball from where it is, or simply go home. HRC chose the former course. In a community facing such fierce opposition from the outside, it is disheartening to see blame and anger hurled at the people on our own side. I know in my heart that HRC's course of action not only supports the goal of transgender equality, but is the best and most expedient way to ensure it.

The fact is that our position and our actions have remained consistent throughout this process. We resolved only to support the passage of an inclusive bill that protects our community to the fullest extent possible. We remain resolved to pass only such a bill, and we are determined to stay in the legislative process, making it both possible and necessary for Congress to do the right thing. By staying at the table, we will prevent precisely what concerns us all-that they take the easier course and leave transgender people behind.

What is being said is, "if we, the transgendered community, who arn't even gay, who haven't done a thing in the political arena, who can't even explain to themselves who they are (never mind the rest of us,gay and straight), can't be included in ENDA, then no one is gonna be protected!" I prefer to wait and witness Hilary shit on us all. I already know what Bush will do. Let's wait for an all inclusive ENDA and see the real democratic ideals fall on their face with a democratic president as well. VOTE THIRD PARTY....
