My view that Justice Scalia is prejudiced against gay, lesbian, bisexual and transgender people is based, not on his position on marriage, but entirely on the angry minority opinions he wrote in two Supreme Court cases in which the majority held that gay and lesbian people had certain rights against discrimination regarding private consensual sex and political activity. In those two virulent dissents, Justice Scalia denounced the court majorities not simply for finding that it was unconstitutional to discriminate based on sexual orientation in cases involving political rights and the right to private consensual sex, but he also made it clear that in his view sex discrimination is not only permitted by the Constitution but is very much in society’s interest because homosexuality deserves to be treated with not only disapproval, but legal disability.
Good for Frank. We are fortunate to have such an intelligent articulate spokesperson on our issues.

Scalia is an oily looking little toad. I saw him in a Columbus Day parade several years ago and had the pleasure of turning my back to him as he slithered by.

Yes, Frank minces no words. Barney sure isn't perfect, but he tells it like it is. Not all judges who rule against gay people are bigots; far from it. But Scalia obviously sees us as being so far removed from the circle of common humanity that there is little other conclusion to come to.

Chris I agree with you on all points. The Barney rants that focus in the right direction suit him well. I do not know if there's any hope for Scalia, however...

You know TrevorHere, I don't think there is any hope for Anton Scalia. The man should never have been appointed to the Supreme Court in the first place. A man who feels we are not even human beings has no place in the Supreme Court--or any office in this country!

Merlyn, I really shouldn't say there's NO hope. It's possible one of his kids ~ or grandkids since they are older ~ will reveal that he or she is gay some day. Then maybe he will have a change of heart. It's happening in my family so it could happen with him, LOL. But not likely while Scalia's still on the bench.

Can you imagine the uproar if he spoke about race the way he speaks of orientation? It is the same thing. What a disgrace that Scalia is. Bravo to Barney Frank. Having to tell a supreme court judge about justice for all is a mockery of the system by that same judge. Scalia is too fond of the eighteenth century for all the wrong reasons.

Look, this all comes down to people who think THEIR world is what THE world should look like. It's arrogance and myopia...what a terrific combination. After Prop. 8 was passed, many straight people expressed such surprise that we were so outraged. And THAT is the problem. They were surprised when our right to marry was stripped away by a mob of ignorant religious zealots? I mean, grow a brain already. We don't even register on their radar. They think everyone is like them. They have no social consciousness, and it stinks.

With regard to Prop. H8 passing, not all religious denominations oppose marriage equality. What galls me is that several denominations' beliefs trumped those that did not oppose our right to marry. Since when do some religious groups get to vote our rights away as if their beliefs are superior to others who are believers, though I for one am not. Why is a religious belief system allowed to interfere in politics anyway, in this instance to vote for discrimination against an entire group of people? Isn't that a direct conflict between church and state?

It's in direct conflict with our secular law's separation of church and state, but it's exactly the point of their religion - to believe you have all the right answers and everyone else is wrong. They believe the creator of the friggin' universe is against homosexuality - you know, the one who sends you to burn in hell for eternity if you do anything he doesn't like. Once you believe something like that, how can you possibly question it. Rational thought flies out the window, never to return.
Their religion is in direct conflict with the idea of religious freedom - which is what gives them the ability to practice their religion in the first place.
Quite the conundrum.
I don't think it's unreasonable to amend the constitution so that it says people can believe whatever they want PROVIDED IT DOESN'T INFRINGE ON OTHER PEOPLE'S BELIEFS.
Eshto, I would love to see that happen but I doubt if it ever will. There are far more believers in our country than in any other western democracy even though right wing sects and cults are losing power. I don't see any democratic president raising the isssue, political suicide for sure. That's the problem with most of our politicians, few are prepared to stick their necks out on anything to do with equality unlike their European and Canadian counterparts.
